On December 23, 2024, the Federal Communications Commission issued FAQs: One-to-One Consent Rule for TCPA Prior Express Written Consent . What is the FCC’s New One-to-One Consent Rule In December 2023, the FCC adopted new rules in the Second Report and Order to combat unwanted and illegal telemarketing calls and texts, including a rule that closed the lead generator loophole. The rule expressly prohibits lead generators, texters and callers from using a single consumer written consent to inundate consumers with unwanted telemarketing robocalls and robotexts from dozens of sellers when consumers visit comparison shopping websites. The FCC made it unequivocally clear that each caller and texter soliciting consumers’ business must obtain a consumer's prior express written consent prior to making such robocalls or robotexts. Under the Commission’s new one-to-one consent rule— which takes effect on January 27, 2025 —the Telephone Consumer Protection Act’s prior express written consent requirement applies to a single seller at a time. In other words, robocallers and robotexters must obtain a consumer’s written consent for marketing messages for each seller. For example, on a comparison shopping website, the consumer could check a separate box for each seller they wish to receive a robocall or robotext from. In addition, such consent must be in response to a clear and conspicuous disclosure that the consumer will receive robocalls or robotexts from each selected sellers, and the content of ensuing robotexts and robocalls must be logically and topically related to the website where the consumer gave consent. When Was the TCPA Enacted, and What is its Purpose? In 1991, Congress enacted the Telephone Consumer Protection Act (“TCPA”), codified in section 227 of the Communications Act of 1934, as amended, 47 USC § 227 , to address certain practices considered to be an invasion of consumer privacy and, in some instances, a risk to public safety. The TCPA generally prohibits making any nonemergency call using an artificial or prerecorded voice to any residential telephone line, wireless telephone number, or certain other telephone numbers (for example, a 911 line, other emergency telephone numbers, or a patient room at a hospital) without the prior express consent of the called party. The TCPA also prohibits making any nonemergency call using an automatic telephone dialing system (also referred to as an autodialer) to certain telephone numbers—including any wireless telephone number—without the prior express consent of the called party. The TCPA generally requires callers to get consumer consent before making certain calls to consumers using an autodialer or an artificial or prerecorded voice. FCC rules require prior express written consent for all telephone calls using an artificial or prerecorded voice to deliver an advertising or telemarketing message to wireless numbers and residential lines (such written consent is also required for calls to certain telephone numbers, including wireless numbers, using an autodialer). In addition, in a 2003 Order , the FCC explained that the TCPA applies to both voice calls and text messages. The FCC’s most recent actions have centered on a consumer’s right to revoke consent when they no longer want robocalls or robotexts and on the growing use of artificial intelligence (“AI”) in calling and texting. In a 2024 Order the FCC took steps to protect consumers by strengthening consumers’ ability to revoke consent to receive robocalls and robotexts and also required that callers and texters implement such requests in a timely manner. More recently, the FCC released a 2024 Notice of Proposed Rulemaking proposing steps to protect consumers from the abuse of AI in robocalls. Are There Written Consent Requirements to Protect Consumers Whose Telephone Numbers are Registered in the Do-Not-Call Registry? The FCC’s Do-Not-Call (“DNC”) rules also protect consumers from unwanted telephone solicitations or telemarketing calls when the consumer has added their number to the National DNC Registry . These additional protections apply to all telemarketing calls, regardless of the technology used to make the call or whether the call is to a wireline or a wireless number. However, even if a consumer’s telephone number is listed in the DNC Registry, the consumer can provide prior express written consent to receive telemarketing calls or texts from a particular seller. To obtain prior express invitation or permission for a telemarketing call to a DNC line, the caller must meet the requirements of section 64.1200(c)(2)(ii) of the FCC’s rules: “Such permission must be evidenced by a signed, written agreement between the consumer and seller which states that the consumer agrees to be contacted by this seller and includes the telephone number to which the calls may be placed.” Why Did the FCC Adopt the One-to-One Consent Rule? In short, the FCC believes that lead generated communications were a large percentage of unwanted robocalls and robotexts and “often rely on flimsy or nonexistent claims of consent.” The FCC also states its belief that while comparison shopping websites that involve lead generation can benefit consumers by enabling them to quickly compare goods and services and discover new sellers, “new protections were necessary to stop abuse of its established prior express written consent requirement.” The FCC also states that “this rule is consistent with the Federal Trade Commission’s Telemarketing Sales Rule, which requires one-to-one consent as well.” Does the New FCC Requirement for One-to-One Prior Express Written Consent Apply When a Third Party is Added to an Ongoing Live Telemarketing Call? The FCC explained in its Second Report and Order that the new one-to-one consent rule would not affect the practice of connecting a third-party agent to a prospective customer on a telemarketing call that is not autodialed and does not include a prerecorded or artificial voice message. “Indeed, the new one-to-one consent rule has no bearing on such calls. It only applies to calls made using an autodialer or prerecorded or artificial voice.” However, if the third party seeks to reconnect with a consumer following this initial live call, the caller must obtain the necessary consumer consent if its future calls will be placed using an autodialed and/or prerecorded or artificial voice. Takeaway: Lead generators and telemarketers should consult with an experienced FTC defense lawyer ahead of the looming one-to-one consent rule effective date. Nebraska women’s basketball player Callin Hake summed it up as well as anyone could. “I think in South Dakota we shot the crap out of it, which is awesome,” the guard from Minnesota said. On that night last weekend in Sioux Falls, South Dakota, the Huskers made a school-record 20 3-pointers on 58% shooting beyond the arc in a 113-70 win against South Dakota. That was three more than the previous record, from 2010. Now comes another game against Creighton where the series at times has at times been defined by the 3-point line — both the ability to make and defend it. The 3-point line is something to watch closely again when the Huskers and Bluejays play at 4 p.m. Friday at Sokol Arena in Omaha, a few hours before the men’s teams from the same schools play at CHI Health Center Omaha. Creighton (1-2) has won two straight in the series. Last year, Morgan Maly made three 3-pointers in the first three minutes of the game and Creighton led the entire game while winning 79-74. Creighton didn’t keep its hot 3-point shooting going the entire game but made nine and outscored the Huskers by 18 points beyond the arc. Nebraska was 3-for-21 on 3-pointers. In 2022, Creighton blasted the Huskers 77-51 after making five of its first eight 3-pointers. “One thing I know is they (Creighton) all shoot it pretty well,” Nebraska coach Amy Williams said. “Last year we gave up eight made threes in the first quarter. That’s something we’ll have to shore up. They’re very, very good off the ball with their movement and cuts so you’re positioning really matters. We’ll have to make the hustle plays and not give them second-chance opportunities.” Creighton has won seven of the last eight meetings with the Huskers. The Bluejays are averaging 10.4 made threes per game during the stretch, while Nebraska is averaging 3.6. The 5-0 and 21st-ranked Huskers faced a major dose of adversity this week when sophomore forward Natalie Potts sustained a season-ending knee injury during Tuesday’s game against North Alabama. She’s scheduled for surgery in two weeks. Williams called the injury is “devastating.” “What a start she’s had to the season, leading our team in scoring and rebounding,” Williams said. “She worked really hard this offseason.” Creighton has reached the NCAA Tournament the past three seasons, making the Elite Eight in 2022, the first round in 2023 and the second round in 2024 with several of the same players that are on the team this year. Creighton may be the most experienced team the Huskers face all season, as the Bluejay playing rotation includes five graduate students, two seniors and two juniors. “We’re incredibly familiar with their roster, and they’re incredibly familiar with our roster,” Williams said. Creighton guard Lauren Jensen has already gone off this season, scoring a career-high 32 in an 80-72 win against Drake. She was 6-for-10 on threes and made each of her six two-point shots. One thing new to the series for Nebraska is Britt Prince, the freshman from Elkhorn North getting her first taste of playing against her hometown school. In the past two games combined, Prince is 15 for 21 shooting. She’s driving to the basket, and also shooting 3s. “She’s gotten more aggressive, and I’d like to see her be even more aggressive,” Williams said. The 113-70 win against South Dakota showed the Huskers what it can look like this season. The Huskers zipped passes around the perimeter to get lots of good 3-point chances. Nebraska had 33 assists on 41 field goals. Hake felt like a lot of inside-outside passes helped the Huskers to the fourth-best scoring total in program history. “When you have posts that are willing to kick it out and give you dimes for passes that makes shooting in a guard’s job a lot easier,” Hake said. “I think we really wanted to carry that forward. The Kansas City Chiefs picked up a road victory — but in true 2024 form, they didn’t make it easy on themselves. Quarterback Patrick Mahomes led a game-winning drive inside the last two minutes, lifting the Chiefs to a 30-27 win over the Carolina Panthers on Sunday afternoon at Bank of America Stadium in Charlotte, N.C. The Panthers, entering the game at 3-7, tied it at 27 with a touchdown and two-point conversion with 1:46 remaining. But that was too much time for Mahomes. His biggest moment was a scramble, as he sprinted 33 yards down the sideline to the Panthers 22 with 39 seconds left to put the Chiefs into field-goal range. Recently signed kicker Spencer Shrader put through the 31-yard field goal as time expired. This one was close because of KC’s inability to stop a before-the-game struggling Carolina pass offense. The Panthers, behind previously benched QB Bryce Young, dissected the Chiefs secondary. Young completed 21 of 35 passes for 262 yards, while Carolina averaged a healthy 5.8 yards per play. KC also got almost no pass rush for a second straight week — a reason for concern as the team prepares for the season’s most important games ahead. Mahomes, meanwhile, played one of his best games of the season, completing 27 of 37 passes for 269 yards with the three scores. The Chiefs led 20-9 at halftime thanks to their efficient offense. Mahomes took advantage of his few possessions then, completing 19 of 24 passes for 207 yards before the break with a pair of touchdown passes to tight end Noah Gray.
